At stake here is the conflict between human rights and national sovereignty and the recognition that the nation state may no longer remain the main and only guarantor of rights in a globalizing world at a time that has seen many new UN conventions regarding rights, the creation of example, a European Criminal Court and of the International Criminal Court.
